 Jack Smith gets right to it.  Here's what you see after the giant USA v DJT header:

GOVERNMENT’S MOTION FOR IMMUNITY DETERMINATIONS

The defendant asserts that he is immune from prosecution for his criminal scheme to overturn the 2020 presidential election because, he claims, it entailed official conduct. Not so. 

What exactly did he do?

(H)e pursued multiple criminal means to disrupt, through fraud and deceit, the government function by which votes are collected and counted—a function in which the defendant, as President, had no official role.  

The Government provided, set forth, and applied actions then requested

that the Court determine that the defendant must stand trial for his private crimes as would any other citizen.

After the introductory remarks, the filing begins to lay out its case.

I. Factual Proffer 

When the defendant lost the 2020 presidential election, he resorted to crimes to try to stay in office.  

 Jack Smith's team wastes no time.  Lying.  Conspiracy. Fraudulent.  Obstruct.  Private criminal effort.  And I'm only on page 4.

There are pages of people (whose names are redacted) telling the defendant that there was no way he was going to win his legal challenges, that the election was lost.  He fired those guys and hired some crazies.  

The defendant created a hermetically sealed environment for himself that put Marin's left leaning bubble to shame.  

He could not accept a loss.  The facts were irrelevant, and fungible over the course of time.

Mike Pence was irrelevant, after he refused to bow to the pressure exerted by the defendant and his minions.  He's in danger?  So what.

That attitude provides the context for what were, in Jack Smith's telling, actions planned well in advance of January 6th.  The document lays out the conspiracy in very readable prose.  It's 165 damning pages.

The timing is interesting.  The material is fascinating.  I hope it dominates the news cycle the way James Comey did in 2020.  I hope it motivates anyone who thought their vote wouldn't matter (the young cashier at the bagel store) to recognize that this is not only a weird guy, he's a scary guy and the only way to stop him is to vote for Kamala Harris.

  1. I sure hope the persuadable undecideds are shocked and appalled by this and vote accordingly. But I despair about the critical thinking ability of my fellow Americans. Sigh.

  2. Given the information that was already out there it is unfathomable how anyone could support this guy, but now that this has been released it seems like a slam dunk. But remember, we live in a country where ~40% of the people have completely lost their critical thinking skills. Moving to the documents case, if ANYONE else had done what he did, they would have been in jail w/o bail since the indictment. But here we are.........

  3. My sister is a Trump supporter. I can't fathom why. She will just shrug it off and say most of it is not true. Instead she is busy attacking Tim Walz on Facebook. She is a good person and a Christian, not that that counts much to me. I'm trying hard to love her.
    That's where we are in this country.

    1. Shrugging it off. The cases will go away. All those former employees? He fired them and it's sour grapes.
      I despair as I watch people I care about fall off the edge....
